About claims and appeals

What does it mean when an insurance claim is denied?

The insurer has refused to pay. Common reasons are a misunderstanding, missing documents, a policy exclusion, an allegation of non-disclosure, or a procedural error in the application or the claim.

Can I appeal if my insurance claim is denied?

Yes, in most cases. You can ask the insurer to reconsider, with more documents or an explanation, within its specified timeline. If the decision stands, you can escalate to IRDAI, the Insurance Ombudsman, the Consumer Commissions and the courts.

Which types of insurance claims can be reclaimed?

Health, life (death benefit), motor, travel, property and commercial claims can usually be appealed if the rejection is not valid under the policy terms and the regulations.

What are the most common reasons for claim denial in India?

Non-disclosure of a pre-existing condition or other information; a lapsed or late-renewed policy; incomplete or inconsistent documents; treatment or damage not covered by the policy; late intimation of the claim; and disputes over valuation, surveyor reports or sub-limits.

How long does an appeal take?

It depends on the claim and how far it has to be escalated. Appeals settled with the insurer are usually the quickest; the Ombudsman and the Consumer Commissions take longer because of their own timelines and due process. We keep you updated throughout.

Do I need a lawyer to appeal a rejection?

Not always at the start: a grievance with the insurer or a complaint to the Ombudsman can often be made without one, although an advocate's help makes a real difference. ClaimsKart brings in legal representation automatically when a case moves to a Consumer Commission or a higher court.

What is the Insurance Ombudsman, and when should I approach one?

The Insurance Ombudsman is an independent authority that settles disputes between policyholders and insurers. You can usually approach the Ombudsman if your grievance is still unresolved 30 days after you filed it with the insurer.
